According to the 2000 census, nearly 600,000 gay couples are not even given the chance to marry. However, it is believed that same-sex marriage would ruin the institution of marriage. The divorce rate of married straight couples is at about 50% with the percentage rising for each additional marriage after the first. Same-sex marriages might ruin the institution of marriage, but straight marriages are already doing this on their own. Either way, it is not fair to accuse a couple of ruining the institution of marriage when they do not have the chance to prove otherwise. Same-sex marriages should be legalized because of religious freedom, separation between church and state, full faith and credit clause, minority discrimination, and the possibility of the increase in child adoptions.
The religious opposing views of homosexuality believe same-sex couples choose their sexual orientation, while homosexuals will fight that they did not choose to be this way as stated by Whitehead (2007). Why would someone choose to be mocked, teased, bullied, and discriminated against? There is no sane answer to that question. Essentially, a key debate of same-sex marriages is whether a person is born this way or if they choose to be a homosexual. However, a study done by Whitehead (2007) shows that even if homosexuality were biological, there would still be religious oppression against same-sex marriages. This study would lead people to further believe that there will always be religious opposition against homosexuality, even if such opposition were proven to be immoral. What is seen in this study is the hatred of same-sex couples through religious affiliations would remain even if “God” created the same-sex couples instead of the individuals choosing the path of homosexuality. Would that make this sinning by creation? Nonetheless, spiritual and religious viewpoints should not pose a formal standing in the decision for accepting or denying same-sex marriage.
Religious freedom, meaning a person can believe and practice what they want without oppression, ensures everyone is treated equally no matter their religious or spiritual viewpoints. Many people in society state same-sex marriage is a sin; however, sinning would classify these individuals under the same religious beliefs and practices of others. “The First Amendment of the Constitution clearly states that a person's religious views or lack thereof must be protected”, (Messerli, 2011). However, a main argument is same-sex marriage is a sin, so it should not be allowed but this would mean that the religious views of same-sex couples would not be protected. Due to the enforcement of religious freedom, a separation between church and state was put into place to keep religious punishments out of the governments laws. The argument that same-sex marriages would be sinning can not influence the decision to make it legal as marriage is maintained under the government, laws cannot be made regarding religious beliefs. If religion could influence government laws many people would still be punished and persecuted for witchcraft for having opposing views, which happened in Salem Massachusetts many years ago. Although the United States was created based on biblical beliefs, it is apparent the system has changed and so should its governing practices.
The founding fathers of the United States of America used the bible as a reference to the way society should act and be treated, thus leading others to feel the government should continue to use the bible as a reference in regard to same-sex marriages. However, the documents created to build the United States have undergone many changes due to the changing ideals of what is acceptable in society, so it should be acceptable to allow further changes to take place. Slavery was another concept within the United States that was referenced to biblical beliefs, but it too was changed to better serve all. Since the United States is currently faced with the rising number of same-sex couples, along with the rising acceptance for same-sex couples, it should change its marriage laws to better serve them as well. If the government continues not to allow same-sex couples to marry, they will be discriminating against homosexuals.
Denying marriage to homosexuals is a discriminative attack against a minority, which is prohibited by the United States of America. Homosexuals are a minority and to deny them marriage would be like denying the marriage of Hispanics (Messerli, 2011). The Bill of Rights ensures protection for minorities so that they may get jobs, loans, cars, and even be married. The Bill of Rights also was enforced to remove slavery and place laws against hate crimes, so such a document should be followed in regard to same sex marriages. “Proponents of same-sex marriage claim that it would promote true equality for gays and lesbians by making it possible for same-sex couples to be full citizens through accessing the full range of benefits that marriage offers to heterosexual couples” (Woodford, 2010, p. 2). Denying one person the right to do something another person is allowed to do, is denying equality. Equality is the basis of the forming of the United States of America. However, the attacks go even further than that as people begin to pick apart the lifestyles of homosexuals.
A main fight is that gay lifestyles reduce life expectancy of the couple to 20% less than straight couples (Messerli, 2011). What is not stated is that this life expectancy drop is due to the chances of the obtaining of HIV or AIDS, while many homosexuals do not have the disease and practice safe sexual practices. HIV and AIDS does not see sexuality when infecting the person, and is not only obtained through homosexual sexual acts. The disease can infect anyone, including straight individuals. Since straight couples are just as vulnerable to HIV or AIDS as homosexuals, the government should deny them marriage just as many people are asking the government to do to same-sex couples. Marriage would also allow and encourage couples to leave behind risky lifestyles for the pursuit of a happy married life. This is the same case with straight marriages. Bachelors and bachelorettes may live life on the risky side with alcohol, drugs, parties and un-protected sexual relations. However, marriage is an encouragement to live healthier for the spouse and relationship. With all the opposition against same-sex marriages, it should be seen that allowing same-sex couples to marry would help out in areas such as adoption issues.
Same-sex marriages would also increase the number of adoptions since the couples cannot produce a child of their own. With homosexuals getting married, they may feel the desire to further their love for each other by raising a family, thus leading to the increase in adoptions. Increasing the adoption rates would allow more children to get out of the orphanages, off the streets and into a loving home. However, an argument is that marriage should go hand-in-hand with the need to procreate, thus making same-sex marriages as nothing more than an exchange of sex as mentioned by Pope (2004). This very argument only further enhances the realization that same-sex couples may adopt.
Some believe children would grow confused on traditions and gender roles in same-sex married families. The only issue with this statement is that gender roles are decreasing as women become and fight for equality. Husbands are accepted to stay home with the children while the women go to work, so the only difference is that the household would have two of the same gender doing exactly as many other families are doing. As children, people are taught to be accepting of others for their differences, why should this be any different? To discourage the love of same-sex partners would be teaching children it is acceptable to hate. Love sees no gender, so the children would not see the difference in love for same-sex partners and for opposite sex partners when they are raised to believe it is acceptable to love all.
A study done by Winslow and Napier (2007) shows that people are stating same-sex marriages would affect the tradition of marriage, but would not affect their personal marriage making this argument appear to be an empty threat of sorts. In this study, James Dobson presents 11 arguments thought to destroy the traditional family. These 11 arguments include couples becoming less likely to get married, have lifelong commitments, and to create emotional bonds. However couples would be more likely to live with partners before marriage, have premarital sex, have affairs, get divorced, engage in polygamy and to be confused about their sexuality. What is not stated is that these things are currently going on with straight couples even though same-sex marriage is not allowed in most states.
The full faith and credit clause, Article IV, Section 1, of the U.S. Constitution, states if a law is legal or prohibited in one state, the law should also be recognized for the other states within the United States. This very clause has been invoked to recognize straight marriages in other states, so the same should be done with same-sex marriages. Although same-sex marriage is legal in a few states, it is either prohibited or seen as a civil union or a domestic partnership instead of a marriage. If same-sex marriage is legal elsewhere in the United States, it should be legal and viewed as legal all over the United States. However, the Defense of Marriage act defines marriage as a union between a man and a woman and allows other states to refuse the right for same-sex marriages. This very discriminative law is a prime example of the contempt that the United States and many of its people has against equality of all individuals.
Not only does same-sex marriage show the love of one person to another, but it also comes with the benefits available to all other married couples. Such benefits include “tax filing status, joint ownership of property, insurance benefits, and agency law” (Messerli, 2011). For couples working hard on a relationship for many years, these benefits can be a huge help in the financial and emotional stability of the relationship. For instance, if a partner becomes ill, the medical staff may not allow visitation rights due to the individual not being considered a legitimate partner. This can cause emotional strain on the couple. The United States of America was formed to be accepting of all people in equality, however still there is opposition for many.
Furthermore, there are arguments of “what if”. If same-sex marriages were to be allowed for legalization, it is viewed that many other situations would arise. Such situations include the marriage of animals, family members, inanimate objects, and multiple partners. Since marriage must be a consensual, it is clear marriage to inanimate objects and animals would never be allowed. As for the marriage of family members, it is currently legal to marry someone’s first cousin in some states. This seems rather strange since same-sex marriage is not allowed in as many states as it is to marry the first cousin. The marriage of multiple individuals may not be legal, but many Mormon individuals have multiple wives. Basically, it appears that the marriage of multiple people and family members is becoming more acceptable than the marriage of same-sex couples.
Legally, there is no reason same-sex couples should not be allowed to marry. All of the reasons behind the objection of same-sex marriage are mainly personal or religious views, which should not affect the government’s laws. It is important to remember everyone is allowed to have religious freedom, making it wrong to persecute someone for different beliefs. With supporting arguments such as religious freedom, separation between church and state, the full faith and credit clause, minority discrimination, and the increase in possibility for child adoptions, the main argument is human kindness. A place built on equality should maintain the idea of freedom in cases such as this. To oppose against couples who would not effect the current institution of marriage, or other marriages, is unjust.
